Mark Cottom acted for residents of two townhouses that adjoined a property on which a dwelling-house and large trees were located. The rapid growth rate of these trees was causing roots to encroach significantly into the yard areas of the clients and resulting in property damage.
Correspondence from Kells persuaded the adjoining property owner to remove the trees, resulting in there being no need for the clients to take proceedings in the Land and Environment Court under the Trees (Disputes Between Neighbours) Act.
