Wills, Estate Planning & Trusts  Contesting Wills

If a deceased person has not named you as a beneficiary in their Will, or has left you something in the Will, but you consider the gift inadequate, you may be eligible to contest the Will.  Challenging the validity of the Will is called a Will "contest".

Alternatively, a challenge to a Will may be based on a claim the Will was not validly executed i.e. not properly signed by the testator or not properly witnessed.  The contest may also be based upon the testator's lack of capacity to execute the Will.
