and businesses continue to grow their wealth.
Quality specialist estate planning is today more strategic then ever. Poor advice is a
threat to succession and wealth preservation. Lindsay Stoddart will provide an
overview of two topics:

  • Testamentary Trust Wills – various types; tax minimisation benefits; asset
    protection benefits with special focus on relationship break down and divorce;
    when is a TTW advisable; when is a TTW essential - not just for high net
    worth clients.

  • Self Managed Super Funds are becoming a popular and worthwhile tax and wealth vehicle. Is the BDBN valid? Does the BDBN document comply? How much of a member’s benefit should be preserved in the fund or should some be dealt with by binding death benefit nomination into a TTW superannuation trust?


Traps and tips for limited recourse borrowings by SMSF’s

Roger Downs will discuss the procedural aspects from a legal perspective: the
structure of the transaction, the documentation required, satisfying the mortgagee’s
requirements, avoiding double stamp duty when eventually transferred to the super
fund after repayment of the loan (and how), and the role members of the SMSF
might be required to play as guarantors.
