Property Settlement

Most cases settle out of Court. However, there may be a need for the Family Court to help you negotiate with your husband or wife to make a final decision if you can’t agree.

Your case may settle at any point in time from when you first consult us. It is difficult to give any precise indication of how long it will take before your case is completed. If your case is not settled after informal settlement discussions, it may be necessary to go to court. Should this be the case, allow about eight to twelve months from the time court proceedings are started.

Time Limit
If you and your spouse have separated or are about to separate, you should talk to us immediately to discuss your rights and to take any urgent steps necessary to protect your rights.

If you are divorced, you have 12 months in which to commence proceedings for a property settlement.
