Richard was admitted as a lawyer in 2003 and was appointed to his current position as Associate in 2009.
Richard has significant expertise in commercial litigation and dispute resolution, with a particular focus on contractual disputes, insolvency and complex defended mortgage recovery actions. He seeks to provide pragmatic and commercial outcomes for his clients.
Richard’s experience enables him to work with clients to develop a strategy to resolve disputes in a timely and cost effective manner, whether through negotiation, arbitration or litigation, as appropriate.
Richard has conducted litigation in various jurisdictions - in NSW this has included the Supreme Court, District Court, Land and Environment Court, Local Court, Industrial Relations Court and CTTT, as well as the Federal Magistrate’s Court.
Richard’s commercial litigation practice includes:
- providing strategic advice on options to address disputes, including the commercial viability to conduct litigation and other options for resolution when acting for defendant clients;
- debt recovery and insolvency – acting for creditors in proceedings to enforce debts through statutory winding up proceedings;
- contractual disputes, including disputes relating to business transactions, sales of business, breaches of contract and enforcement of guarantees;
- acting for liquidators in the recovery of preferential payments from unsecured creditors;
- the conduct of mediation and settlement conferences with respect to disputes;
- acting for defendants in prosecutions under the Occupational Health and Safety Act;
- acting for defendant land owners in defence of prosecutions of under the Protection of the Environment Operations Act; and
- appearing in proceedings for local councils in the Land and Environment Court.
Outside of Kells, Richard is a keen follower of American football and restores pinball machines.
