  • Step 1: Listing your property for sale

    In New South Wales, a draft contract must be prepared before your property can be advertised. To begin the process in Kiama, we:


    • Provide a cost agreement outlining what’s included
    • Share a property information form for you to complete
    • Order the required certificates from Land Registry Services, your local council and the relevant water authority
    • Compile the draft contract and deliver it to your real estate agent to begin listing the property

  • Step 2: Exchanging contracts

    The exchange of contracts is when the agreement becomes legally binding. Up until this stage, buyers can continue to make offers.


    In most cases, buyers are entitled to a five-business-day cooling-off period once contracts are exchanged. This timeframe is designed for the purchaser but can be shortened or waived by mutual agreement. After the exchange, sellers are committed to the sale and cannot withdraw.


    Once an offer is accepted, buyers typically:


    • Obtain full loan approval if finance is needed
    • Arrange pre-purchase reports such as building, pest or strata inspections
    • Sign the contract with their legal representative
    • Pay the deposit
    • Send the contract through for formal exchange

    As the seller, you will also sign the contract either through our office or via your agent.

  • Step 3: Completion of your sale

    Settlement finalises the transaction, transferring ownership to the buyer and releasing the balance of funds.


    Before settlement, the buyer usually conducts a pre-settlement inspection to confirm the property’s condition matches the state it was in at exchange.


    On settlement day, you will need to:


    • Vacate the premises (unless it is occupied by tenants)
    • Leave the property in the same condition as at exchange
    • Cancel utilities such as power, gas and internet
    • Arrange for all keys, garage fobs and access devices to be delivered to your agent

    Our team manages the release of funds, which includes:


    • Paying out any loan secured over the property
    • Settling any outstanding Council rates, water fees or strata contributions
    • Transferring commission to the agent
    • Deducting legal costs
    • Sending the balance to your nominated bank account

    You will receive a full breakdown of all financial transactions completed at settlement. Once everything is finalised, we confirm with both you and the agent so the buyer can collect the keys.
