How Can Our “No Win, No Fee” Shellharbour Motor Vehicle Compensation Lawyers Help?

If you’ve been injured in a car crash, speaking with one of our motor accident lawyers early can help you understand your rights and improve your chances of a successful claim.

Whether you were driving, a passenger, walking or cycling at the time, you could be entitled to compensation if someone else was at fault. Claims are generally made through the CTP (green slip) insurer of the other party involved. If the vehicle was not insured or can’t be identified, your claim may be made through the Nominal Defendant.

What you may be eligible to receive depends on when the accident took place. Incidents that happened before 1 December 2017 are assessed under the Motor Accidents Compensation Act 1999. For those that occurred on or after that date, the Motor Accident Injuries Act 2017 applies.

  • NSW Motor Accident Claims Prior 1st December 2017

The Motor Accidents Compensation Act 1999 (MAC Act) applies to people who were injured in a vehicle-related incident that occurred before 1 December 2017.

What defines a motor accident under the Motor Accidents Compensation Act 1999?

A motor accident refers to any event involving the operation or use of a vehicle that results in injury or death. This can occur in circumstances such as:

    • While the vehicle is being driven
    • A collision or an attempt to avoid one
    • The vehicle losing control
    • A hazardous situation caused by the act of driving, an impact, or the vehicle going out of control

    The definition also covers:

    • Situations involving the parking or upkeep of a vehicle
    • Use of a trailer connected to the vehicle, or a trailer that becomes detached and causes harm
    • Tow trucks, including incidents involving an uninsured vehicle being towed or carried

You might be the driver, a passenger, someone walking nearby, or even riding a bicycle. Claims can also stem from incidents involving vehicles like forklifts or similar machinery. For that reason, it's important to speak with a lawyer about your circumstances.

The amount you may be entitled to depends on:

    • The degree of long-term impairment
    • Wages lost during recovery or reduced capacity to earn
    • Ongoing medical treatment or rehabilitation expenses
    • The need for domestic help at home
    • The impact your injury has on your ability to work in future

You must report the crash within 28 days and submit a Personal Injury Claim Form within 6 months from the date of injury. If you're outside these deadlines, you may still have options. Contact our motor vehicle accident team in Shellharbour to discuss your situation and find out how we can assist.

  • NSW Motor Accident Claims After 1st December 2017

The Motor Accident Injuries Act 2017 applies to people hurt in vehicle-related incidents occurring on or after 1 December 2017.

Whether the incident was your fault or someone else’s, you may have access to compensation. If another person was responsible for the crash, your entitlements may extend further and include additional support.

This applies to a range of incidents including car crashes, truck or bus accidents, forklift mishaps or injuries caused by other motorised equipment. It covers drivers, passengers, pedestrians and cyclists alike.

Key timeframes to be aware of:

    • The accident should be reported to police within 28 days
    • Your application for compensation should be lodged within 28 days
    • If you miss this period, you must submit your claim within 3 months of the accident date

Missing these deadlines can put your claim at risk. However, even if you’re outside the timeframes, we recommend contacting our team to explore possible options.

If your application is approved, you may be eligible to receive:

    • Weekly income support
    • Payment of medical and treatment costs
    • Domestic assistance if required

Once your condition has reached a stable point, an assessment will be carried out to determine if you qualify for non-economic loss (such as pain and emotional distress). If your injuries are classified as minor, access to compensation will be limited.

If your application is rejected, it’s important to speak with one of our Shellharbour motor accident lawyers. We can help you understand the reasons for the decision and guide you through the next steps.

    Death Claims

If a loved one has passed away in a road incident, their family may be able to claim funeral expenses and support for dependents. There may also be grounds for a damages claim. It’s highly important to seek legal advice in these circumstances.

Our Shellharbour compensation team has supported many individuals injured in various traffic incidents, including crashes involving intoxicated or distracted drivers, pedestrians struck on crossings, and cyclists hit by cars.
